Rail Authority: Private Property Owners Being Treated Fairly in Real ...

BY MALIA ZIMMERMAN?- The city's Honolulu Authority for Rapid Transportation, which is acquiring private property in the way of the city's 20-mile elevated steel on steel rail system, maintains its officials have treated private property owners along the route with respect and paid them the full value for the land the city has acquired.

The Farinas family, which lives in Pearl City, has a different take. They said in a recent letter to HART shared with Hawaii Reporter that their 10 family members, dogs, cats and 65 chickens are being displaced without ample time to move.?The family said it is in a panic because HART officials told them they must?vacate their home within the next three weeks.?The adults each work 40 hours a week, and the family operates an open market vegetable business seven days a week. They have no time to prepare for such a major undertaking.

"Our family has been assured by HART representatives that we would not be 'rushed off' and would be given ample opportunity to relocate our property, animals and farm equipment. ... It?is completely unreasonable and heartless for you and your agency to believe that it is even possible for our family to vacate our home, farm and business within three weeks, while working 40 hours a week and caring for our family.? Not to mention, we have yet to secure farm land for all of our chickens," the family wrote.

The Farinas family said if HART needed their property by August 20, 2012, the rail authority "should have invested the time, energy and effort into finding a suitable replacement property at an earlier date.?As it stands, we have had to find our own 'relocation property' and are losing approximately 14,000 sq. ft. of land, along with a vegetable garden, chicken farm and access to well water ? all of which are irreplaceable to the values of our family and culture."

But HART?Real Estate Acquisition Manager?Jerry Iwata said the family was?notified on March 14, 2012, that they have a minimum of 90 days?before a 30-day notice to vacate would be issued. The 30-day notice was issued?on July 17, 2012, he said.

The city has treated the Farinas family fairly, Iwata said. They were paid a mutually agreed price of $558,000 for the property in?September 2011,"which put the ownership of the property under the City and the Farinas family was also offered relocation assistance in line with federal?policies."?HART also contracted with Helping Hands Hawaii to further assist them with?their needs, Iwata said.

Since the city purchased the property, the family has continued to live on the property they once owned but has refused to pay rent to the city, Iwata maintains. In addition, he accused them of subleasing parts of the city property.

"Ample time has clearly been provided to the Farinas family, but HART also has?the responsibility to protect taxpayers? interests," Iwata said. "Any reasonable taxpayer would agree that HART has been more than?fair and must now protect the public?s interest."

As tension builds between HART officials and property owners in negotiations with the city,?Honolulu City Council Budget Chair Ann Kobayashi plans to hold a hearing tomorrow at 9 a.m. on the real estate acquisition and condemnation issue.

She said she has been receiving complaints from residents and business owners along the rail route because they are being told they must move, sometimes with little notice, and she is encouraging others to share their stories.

Kobayashi notes HART has upped its condemnation?budget from $90 million to $214 million, meaning even more residents could be impacted.

She will ask HART officials to explain their plans for condemnation along the route, which spans from West Oahu to Honolulu.

"We want to have a discussion because we have heard many concerns from property owners. We want to know what is going on, what the process is for condemnation, why people are being treated unfairly, how much taxpayer money is being spent, and whether all property owners have been notified of the city's plans," Kobayashi said.

Three Ways to Give Your Writing Speed a Boost | Article Marketing ...

Not everyone can publish as fast as Stephen King or even Dean Koontz but there are techniques that can help give the wriitng speed a boost. But first, I need to explain several things before we can arrive at that point.

First of all, you should spend some time on the means of writing itself. To put it differently, you need to know the basics because a lot of writers use whatever strategy which is comfortable for them. If they figured it out along with worked on this strategy, they?re able to take this knowledge as well as run with it. They shortly begin to write like their lives depend on this. For some it, really does.

Most writers use a deadline and it is a necessity for them to keep it if they want to geth their money promptly and be able to keep their own jobs. For others, they have to write a certain quantity of articles for that month because if their commitment states they need to have a certain number of posts submitted on a selected date then that maybe what they?re getting paid for.

As you can see, these authors have no choice however to write fast.

So if you want to learn how to write quickly, I will show you a number of techniques I think will let you. Some of these techniques We have used myself and are beneficial to maintaining your goal.

One technique I take advantage of is cursive writing with a smooth flowing pencil and I happen to just like two types of pens. The particular Pilot G-2 and the world?s first sharpie pens. I like precisely how these pens really feel when I?m producing and the ink can be fast and they do not skip like standard ballpoint pens do. I do not use anything else. If you get a chance and have a few extra bucks to be able to spare give them a try sometime. You might see why I love them. Or better yet, try different pencils and pick out the people you like best.

Using cursive writing, and of course, the best pen, I can take flight right along the site. It seems my hand is aware what my mind would like to say even before I do. I know that may seem unusual but it seems to us my hand does every one of the thinking.

Before My spouse and i start writing, although, I close my eyes and loosen up. Then I let our pen do all the work. If I like precisely what I?ve written, the idea stays. If I don?t, it goes. Simple while that. I go back again later and make every one of the necessary changes.

As long as you?re doing this, you want to retain writing and try never to stop for anything. Don?t think and don?t modify your work until your own piece is done. Editing comes later.

An additional technique is dictation. You use a dictating device or a words recorder and document your written substance. You then go back, available your favorite word processor than play it back again so you can type everything out. I merely tried this one simply because I like handwriting far better. It?s more efficient to me I think. Besides, We worry too much concerning having to rewind only to get the parts My spouse and i missed.

I haven?t learned about this until a pal of mine mentioned it to me while I was discussing the number of choices that someday organic beef be able to plug our minds into the personal computer so when the computer senses what we?re pondering the words will pick up on the screen. I?m not sure if this will ever come about or if it has occurred but it sounded decent to me. Anyway, the lady said there are some pcs that have a words recognition software program built into the computer and all you are doing is record your current written material into the built in microphone. As it plays your voice back you can sort everything into your expression processor. I have this specific on my Presario but I didn?t had time to mess around with it.

So the final point here is this. Give all these techniques a try and if you happen to fall in love with one of them, stick with it, along with a little practice, your current writing speed will increase in no time at all.

Are You Sharing Too Much With Your Kids? | Black and Married ...

I was in the salon the other day and overheard a rather interesting conversation. A client was talking about her frustration with her husband?s approach to handling delicate family situations. She stated that he always wants to be upfront and honest about everything with their children because that?s the way HE was raised. That alone wasn?t really her problem. Her gripe was that she believes that children don?t need to know everything!! I looked up from my iPhone to acknowledge my agreement with her and was welcomed to join the the conversation.

Before I could delve into this discussion, I needed to hear some specifics. (Be careful what you ask for.) She stated that because they were going through some financial trials, her husband shared with their 12 year old daughter that they were no longer doing certain frivolous weekend activities to cut back on spending and proceeded to say they may be heading to foreclosure on their home. She was mortified! To make matters worse, she said that her 10 year old son was having nightmares after her husband told him about his plans to have a vasectomy!

Ok! Screech! Wait! Timeout! What!?! I could agree with the sharing of the financial situation because I have had conversation with with my own tween once: Son, We are NOT the Trumps. There is MONEY coming from my account with every SWIPE. It is not magic!? But all the extra details that Dear Ol? Dad provided were a bit much. I could see why she was livid! But me (as usual) playing devil?s advocate, I told her that I agreed with her husband. It all depends on a child?s age. I feel that they need to be aware of certain things, that are AGE APPROPRIATE and in a way that won?t cause alarm. Your vibe and delivery are everything! You know better than anyone else what your children can handle. If you?re not good at this, then yes, you may want to just leave the subject alone.

I?m somewhat of a private person. So, naturally, Only a few people in my life know more than what?s on Facebook, Twitter or my blog. I like it that way. Therefore, I?m inclined not to tell my children any and everything that I don?t want repeated. I also feel that children can?t relate to heavy topics due to lack of maturity. Plus, I feel like these sweet babies of ours are only children for a short while and grown-ups for the rest of their lives. Giving them fully-loaded information can either be exaggerated by their own little imaginative minds (potentially leading to devastation) or it blows right over their head like a jetliner. Whatever your stance is, there is always a delicate and thin line that you have to walk in order to raise savvy little people, and at the same time, protect them.

In 2009 a Manchester woman Clare Wood, 36, was strangled by ex-boyfriend George Appleton who then committed suicide. Appleton had a record of violence against women including kidnapping an ex-girlfriend at knifepoint. At this point a campaign was begun by Clare?s family to allow women to check whether a prospective boyfriend had a history of domestic violence. Their efforts have resulted in the Home Secretary Theresa Ma agreeing to a trial of what is colloquially known as Clare?s Law in Wiltshire and Gwent ( http://www.telegraph.co.uk/news/uknews/law-and-order/9401303/Clares-Law-trial-to-begin.html)

Clare?s law will allow a person to get the police to check whether a man (or in these pc times a woman) they intend to start a relationship with has any history of domestic violence: ?Under the scheme, both men and women will be able to apply to check on a partner with whom they are embarking on an ?intimate relationship?. (Ibid)

Astonishingly, third parties are also allowed to make applications:

?Applications will also be allowed from family members, friends and neighbours on behalf of another person if they have a ?reasonable? fear that they may be at risk.? (ibid)_

There is a considerable lack of detail about the trial, but from media reports it appears that all the government agencies involved in domestic violence cases ? the police and various social services ? will share their information on an alleged abuse. In addition, there is an intention for the police or any other public service involved in domestic violence work to actively seek out those involved with someone who has a history of domestic violence but who has not sought information about the person they are involved with and inform them that their partner has history of domestic violence.

What information will be considered as evidence of domestic violence is unclear. It might only be criminal convictions but that is unlikely. Cautions, which technically are not part of a criminal record, would surely be included. It is likely that information which has not resulted in a conviction or caution would be used because of the proposed sharing of information between the police and other agencies and the natural desire of public servants to cover themselves against any accusations of incompetence or dereliction of duty. ( Imagine the outcry if the police knew from social services of accusations of domestic violence but did not pass on the information to someone who was later assaulted. )

The minimum that could revealed to an applicant for information would be a statement that a person did or did not have a history of domestic violence. It will almost certainly be more detailed , because domestic violence includes violence against children so the target of the violence would have to be revealed. Then there is the question of the frequency and degree of violence . It would make little sense to simply tell a woman that a man had been violent against other women or children because that would not allow the woman to assess the risk.

The quality of the information held could be very questionable. Cases of domestic violence are often a matter of one person?s word against another. Injuries may be slight or if more serious difficult to ascribe to one side or the other. A woman may have a black eye, but whether she got as she claims from her partner hitting her without physical provocation or it was caused when the man defended himself from an attack by the woman is next to impossible to tell. Another likely scenario could be injuries caused by accident which one or other of the parties claims were deliberate. The danger in the context of Clare?s law is that the police and social services will record incidents which do not result in charges or a caution and these will be treated as evidence of domestic violence even though nothing has been proven or admitted.

Then there is the question of what the police will do about a man who has a history of violence but not domestic violence. It is all too probable that non-domestic violence will, if not immediately, be eventually brought into such background check, most probably after a woman is killed by someone with a history of violence but not non-domestic violence. Nor would that necessarily be the end of policy creep because if violence is revealed to a prospective or actual partner why should not drunkenness, drug use, serious non-violent crimes and suchlike also be revealed?

Even at its narrowest this system would be a gross intrusion into the privacy of the individual. It could result, in extreme cases, of a person being constantly denied a normal intimate relationship through either the police or social services actively pursuing their attempts at relationships and sabotaging them. The other danger is that the idea of asking for a police check could become routine, either in the population as a whole or amongst certain groups, for example, the middle class or single parents. That could also regularly sabotage attempts at relationships. A person, especially a man, who suffered such treatment, could lose control and turn violent not against prospective partners but those who were sabotaging the relationships.

There is also the question of what the state would end up doing if a woman knew that her partner was violent but stayed with him regardless. In the ever more aggressive politically correct British state it is not implausible that a few years down the line the scope of Clare?s law would be broadened to enable the banning of those with domestic violence in their past from any intimate relationship or the removal of children from a woman if she persisted with a relationship with a man with a history of domestic violence. Incredible? Well, reflect on the readiness of social services to remove children from their parents which already exists.

The gross intrusions into privacy are just one of the serious ills A person gaining information about a person?s tendency towards violence and any convictions would be an open invitation to either blackmail or malicious behaviour which would lead to the person declared violent having their past revealed to employer, family members and friends. This could result in the fracture of important social relationships and the loss of a job. The question of employment is particularly interesting because under the Rehabilitation of Offenders Act someone could have legally withheld a conviction for domestic violence from an employer . If Clare?s law becomes permanent government policy and enshrined in law, we would have the absurd situation of one law being potentially undermined by another.

There is also much scope for false accusations of domestic violence, both by spurned partners or third parties such as neighbours. Even if such an accusation does not result in a conviction or caution, the details would end up on a police or social service database and provide grounds for warning an applicant for details about a prospective partner that the person inquired about had been violent towards a partner or child. Those who imagine that malicious accusations or attempts at blackmail would be rare should keep a watch on the mainstream media and count the number of cases where women have attempted to blackmail men or have made false accusations or rape. You are unlikely to find a week which goes by without a court case for one or the other crime being reported.

There will be some people who offer a serious risk of serious domestic violence , but there are many more people who offer a high risk of violence other than the domestic type or are likely to commit other serious non-violent crimes. They are rarely incarcerated for life. Society at large is left to accommodate them. If we can do that for rapists and murderers, it is perverse to say we cannot accommodate without gross state intrusion into their personal lives people who will often have displayed behaviour far less harmful.

Some interest groups which specialise in the protection of battered women have reacted against the scheme on the grounds that it will have little effect because most of those who experience domestic violence do not report it to the police or social services. This is probably true but it misses the real point, namely, the immensely authoritarian nature of the proposal and the opportunity it provides for blackmail, malicious accusation and politically correct jobsworths pushing the rules to absurd lengths as they try to show they are the most politically correct of beings.

What is likely to happen? In the immensely politically correct atmosphere of modern Britain it is more a less a certainty that it will become law after the trials are over. If it does it will be another nail in the coffin of English liberty and pile on the police and social services a quite unnecessary extra burden.

The fact that the policy exists at all is down to a distraught family pressing for some means to make sense of a relative?s murder. That they should behave so is readily understandable. What is not acceptable is for private grief to be taken up by the mainstream media and politicians for their own politically correct authoritarian purposes. Private grief should not be used as a lever for authoritarian ideological policies to become law.

If anyone recklessly breaches an order they can face a fine or a maximum 12 months in prison.

16 Contravention of order

(1) A person commits an offence if the person engages in conduct that constitutes a contravention of a suppression order or non-publication order and is reckless as to whether the conduct constitutes a contravention of a suppression order or non-publication order.
Maximum penalty: 1,000 penalty units or imprisonment for 12 months, or both, for an individual or 5,000 penalty units for a body corporate.
(2) Conduct that constitutes an offence under this section may be punished as a contempt of court even though it could be punished as an offence.
(3) Conduct that constitutes an offence under this section may be punished as an offence even though it could be punished as a contempt of court.
(4) If conduct constitutes both an offence under this section and a contempt of court, the offender is not liable to be punished twice.
